The right to a lunch break is undeniable for any employee who works full time. The Labor Code clearly states that work without a break for lunch is a serious violation, so the bosses are obliged to give employees time for food and rest in the middle of the shift.

The lunch break is created, first of all, to meet the physiological needs of a person, the feeling of hunger will necessarily arise and it will be necessary to satisfy it, because a hungry worker can not fully work, so giving him such an opportunity is definitely in the interests of management. However, another important function of the lunch break is a change in the type of activity and rest that positively influence the working capacity and allow the employee to undertake new tasks with the new forces.

Duration of lunch break

It is important to remember that a lunch break is not included in the working time, that is, if you have an eight-hour working day with a regulated break for an hour, then starting work at 9 am, you can finish it no earlier than 18:00. Unauthorized reduction of the lunch break to reduce the duration of the working day is unacceptable - the time of its beginning and the duration should be specified in the employment contract that you signed when applying for a job. Of course, you can try to negotiate with the authorities personally, but for him it threatens to violate labor laws.

The lunch break is not paid for, therefore it is the personal time of each employee, whom he can dispose of at his own discretion and does not have to be in the office at all.

The minimum duration of a lunch break according to the Labor Code is half an hour, the maximum is two, but it usually ranges from 40 to 60 minutes and is determined by management. Ideally, lunch time should be calculated based on the location of the catering place where the employees are dining, and include time for the trip there, use of a full meal, compulsory rest after meals and hygienic procedures. It is important for young mothers to know that their lunch break is calculated somewhat differently: they are entitled to feed the child, 30 minutes every three hours. This time can be summed up and transferred to the beginning or end of the working day, moreover, it is paid.

The beginning of the lunch break is also determined by the authorities, and, as a rule, depends on the time of the beginning of work, the general regime of work, the complexity of production and fatigue of employees.
