How are child support payments calculated?

The birth of a child immediately imposes an obligation on its parents to maintain it. And even in the event of a divorce, both the mother and the father are required to keep their baby until the age of 18.

Sometimes parents are able to calmly find a compromise about exactly what kind of help each of them will provide, but basically, the decision on how exactly alimony will be paid is taken by the court.

How is alimony calculated in Russia?

According to article 13 of the Family Code of the Russian Federation, cash assistance can be paid in accordance with an agreement concluded between the mother and the father of the child and certified in the notary. This document usually indicates a fixed amount of money that will be paid by one of the parents monthly or quarterly, as well as the order of indexation of this payment. In addition, absolutely any conditions can be prescribed here.

Meanwhile, in most cases, parents can not take a decision that suits both of them on their own, and one of them, more often - mother, is forced to seek help from the judiciary.

According to the provisions of Article 81 of the Criminal Code of the Russian Federation, the court awards maintenance of alimony from wages, pensions and other payments in the amount of 25% of the total income that the parent has if he leaves one child in the family. For two children, the retained share will be one third, if there are 3 children left in the family, or even more, you will have to give half.

But how, then, do you get alimony from a non-working citizen? In such a situation, the court is entitled to award a monthly cash payment in a fixed amount, taking into account the subsistence minimum in the city or region of the child's residence.

How is alimony calculated in Ukraine?

As a rule, in Ukraine child support is calculated in different ways, after studying the needs of the child and the incomes of both parents. Meanwhile, there is a general rule - alimony for the maintenance of your son or daughter can be at least 30% of the subsistence minimum.

Today, the subsistence minimum for children under the age of 6 years in this country is 1102 UAH, and from 6 to 18 years - 1373 UAH.

How is the support payable calculated?

The court may also decide to recover the debt from the father or mother, evading their duties. Calculation of the debt is made, based on the established agreement or a previously adopted court decision.
